01Who we are

Fer Factor ("we", "us", "our") is an independent game studio based in Lagos, Nigeria.

02Using this website

You can browse this site for personal, non-commercial use. Please do not attempt to disrupt, overload, or gain unauthorised access to it, or scrape it in a way that harms its operation.

03Our games

Our games are licensed, not sold. When you get one of our games, we grant you a personal, non-exclusive, non-transferable, revocable licence to play it for your own entertainment, subject to these terms and the terms of the platform you got it from.

Purchases, refunds, and accounts are handled by the store or platform you use, such as Steam, under its own terms. Where those terms conflict with ours on purchases or refunds, the platform terms win.

04What you can't do

• Copy, sell, rent, or redistribute our games or any part of them.
• Reverse engineer, decompile, or modify our games, except where the law allows it or we have released official modding tools.
• Cheat, exploit bugs, or use unauthorised software to gain an unfair advantage, especially in any online or competitive feature.
• Harass other players or post content that is illegal, hateful, or infringes someone else's rights in our communities.

05Content creators

We love seeing our games on stream. You are welcome to make and monetise videos, streams, and screenshots of our games, as long as you do not imply an official partnership and you do not simply re-upload our trailers or soundtracks as your own. We can withdraw this permission for content that is abusive or misleading.

06Intellectual property

The Fer Factor name, logos, games, artwork, music, characters, and everything on this site belong to Fer Factor or our licensors and are protected by copyright and trademark law. Third-party logos shown in the press section belong to their respective owners.

07Community and feedback

If you send us ideas, suggestions, or feedback, you agree we can use them without owing you anything. Our Discord and social channels are run under those platforms' own rules, and we may remove content or members who break them.

08Early access and updates

Games in development, demos, and early access builds can change a lot, contain bugs, or lose progress. We may update, change, or remove features at any time.

09Third-party links

This site links to other websites and services. We are not responsible for their content or practices.

10Disclaimers

The website and our games are provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, that they will be error-free, uninterrupted, or fit for a particular purpose.

11Limitation of liability

To the fullest extent the law allows, Fer Factor is not liable for any indirect, incidental, or consequential damages arising from your use of the site or our games. Our total liability for any claim is limited to the amount you paid for the game in question in the 12 months before the claim. Nothing here limits rights you have under consumer protection law that cannot be waived.

12Ending access

We may suspend or end your access to any online features of our games if you break these terms. You can stop using the site and our games at any time.

13Governing law

These terms are governed by the laws of the Federal Republic of Nigeria. Disputes will be handled by the courts of Lagos State, unless the law where you live gives you the right to bring a claim locally.

14Changes

We may update these terms from time to time. When we do, we will change the date at the top of this page. Continuing to use the site or our games after an update means you accept the new terms.
